What is a Constable?

Constable’s and their authority differ from state to state. In Utah a Constable is a law enforcement officer with special functions. Those functions are to serve process, provide court security (Bailiff Duties), transport prisoners, seize property, enforce writs of all types and effect service of arrest warrants and may make probable cause arrests. Constable’s appoint deputies and like other law enforcement agencies maintain the standards and training they received from the police academy.

What is process serving?

A means of giving legal notice to a party involved in a court proceedings. There are different kinds of documents that are delivered by Constable’s. The most common types of court orders are: Small Claims, Summons,(These are pre-judgment and are notify about the lawsuit and to give notice of a hearing or an amount of time to respond to the complaint or petition.) Subpoenas, (These are to have a third party to the lawsuit produce supporting documents or testimony to the case.) Supplemental orders,(These are post-judgment and are to attend a hearing. The hearing is used to set up a payment arrangement and to answer questions like where the defendant works and banks.) Garnishments,(Garnishments are used to seize wages or funds from banks accounts to repay debts.)Writs of Execution,(These are used to seize personal property to be sold at a Constable’s sale to help satisfy a judgment.) Restitution’s,(These are to remove people out of a dwelling.)Bench Warrant(If a person fails to obey a court order they may receive Bench Warrant issued by a judge)

Who can serve court documents?

  • A private process server can only serve a Summons, Small Claims and Subpoena.
  • A Private Investigator can serve anything a Process Server can plus Supplemental Orders and Garnishments.
  • A Constable or Sheriff can everything a Private Investigator can plus Writs of execution, Orders or Restitution, and Bench Warrants.

Why use a Constable?

Constable’s can serve all types of court documents and are regulated in such a way that they have to be honest and full of integrity. Since Constable’s are appointed for terms, if they don’t uphold those values set forth by POST, and uphold the law they won’t be reappointed. Unlike the Sheriff, Constable’s do not receive any public funding so their jobs depend on getting the job done in a fast and efficient manner to keep their clients happy. The way Constable’s handle themselves is defined by state statute unlike Private Process Servers and Private Investigators; so you know Constable’s will always do what’s right when it comes to serving process.
